Appeals Policy

1. Introduction

pole.world ("we," "us," or "our") operates pole.world as a platform for adult live-stream content. This Appeals Policy sets out the rights of individuals to appeal decisions made following a complaint investigation, and the separate right of any person depicted in content on our platform to request the removal of that content.

This Policy should be read alongside our Complaints Policy and our Terms of Service, both available at pole.world. Appeals submitted under this Policy will be handled independently and impartially.

2. Part A - Content Depiction Removal Requests

This part of the Policy applies specifically to individuals who appear in, or are depicted within, content hosted on pole.world, and who wish to request the removal of that content.

2.1 Your Right to Request Removal

If you are depicted in any content available on pole.world, including live streams, archived VOD content, preview images, or thumbnails, and you wish to request its removal, you may contact us at any time.

Requests may be made on any of the following grounds (non-exhaustive):

  • You did not consent to the recording, broadcast, or publication of the content;
  • Your consent was withdrawn prior to or after publication;
  • The content was produced under duress, coercion, or deception;
  • The content was published in breach of an agreement between you and the performer or platform;
  • You were a minor at the time the content was produced;
  • The content constitutes non-consensual intimate imagery;
  • You have another legitimate legal or personal reason for seeking removal.

How to Submit a Depiction Removal Request

If you have been depicted in any content on pole.world and wish to appeal for its removal, please contact us by email at appeals@pole.world. Please include your full name, a description or link to the specific content, and the reason for your request. We will acknowledge your request within two (2) business days and aim to resolve it within five (5) business days.

2.2 Review of Depiction Removal Requests

Upon receipt of your request, our Trust & Safety team will:

  • Acknowledge your request and issue a reference number within two (2) business days;
  • Verify your identity and your depiction in the content;
  • Review the grounds for removal against our Community Standards, Terms of Service, and applicable law;
  • Contact the relevant performer where appropriate and where doing so does not put you at risk;
  • Reach a decision and notify you of the outcome within five (5) business days of receiving your complete request.

Where there is an immediate risk of harm, or where the content appears to involve a minor or non-consensual material, the content will be restricted or removed as a precautionary measure pending full review.

2.3 Disagreements - Referral to a Neutral Body

We are committed to resolving all depiction removal requests fairly. However, where a disagreement arises between you and pole.world regarding the outcome of a removal request, for example where we have declined to remove content that you believe should be taken down, you have the right to have that disagreement resolved by an independent, neutral body.

In such cases:

  • You may notify us of your wish to escalate by emailing appeals@pole.world with the subject line "Neutral Body Escalation" and your reference number;
  • pole.world will engage in good faith with the neutral body's process and abide by any determination made;
  • The neutral body will be independent of pole.world and will assess the matter on its merits;
  • Both parties will be given an opportunity to submit evidence and representations to the neutral body;
  • We will meet our own reasonable costs associated with the process and will not seek to recover those costs from you.

External Redress

Referral to a neutral body does not affect your right to seek redress through national courts, regulators, or other statutory bodies available in your jurisdiction. This Policy is without prejudice to any legal rights you may have.

3. Part B - Appeals Against Complaint Investigation Decisions

This part of the Policy applies to individuals, whether the original complainant or the performer or user against whom action has been taken, who wish to appeal a decision made following an investigation under our Complaints Policy.

3.1 Who May Appeal

The following individuals may submit an appeal under this section:

  • The complainant, where they are dissatisfied that insufficient action was taken in response to their complaint;
  • The performer or user against whose account or content an action has been taken (e.g. content removal, suspension, or permanent ban), where they believe the decision was wrong.

3.2 Grounds for Appeal

An appeal may be submitted on one or more of the following grounds:

  • The decision was based on inaccurate or incomplete information;
  • A procedural error occurred that materially affected the outcome;
  • New evidence has come to light that was not available at the time of the original investigation;
  • The outcome imposed was disproportionate to the nature of the violation.

Appeals submitted on grounds not listed above will not be accepted, except in exceptional circumstances at our sole discretion.

3.3 How to Submit an Appeal

Appeals must be submitted in writing to appeals@pole.world within fourteen (14) calendar days of the date of the decision notification. Please include:

  • Your full name and the reference number from your original decision notification;
  • A clear statement of the ground(s) on which you are appealing (from those listed in Section 3.2 above);
  • Any supporting evidence or arguments you wish the appeals reviewer to consider.

Appeals submitted outside the 14-day window will not be accepted, except in exceptional circumstances at our sole discretion.

3.4 Appeals Review Process

All appeals are reviewed by a senior member of our Trust & Safety team who was not involved in the original decision. The appeals reviewer will:

  • Review the original complaint, investigation record, evidence, and decision;
  • Consider the grounds and any additional materials submitted with the appeal;
  • Reach an independent determination within ten (10) business days of receipt of the complete appeal.

3.5 Appeal Outcomes

Following an appeal, the reviewer may:

  • Uphold the original decision, confirming that the original outcome was appropriate;
  • Partially uphold the appeal, modifying the outcome (for example, reducing a permanent ban to a temporary suspension);
  • Overturn the original decision, reversing the action taken and, where appropriate, restoring the content or account.

Both parties will be notified of the outcome in writing. Where an account has been suspended or content removed and the appeal is upheld, any applicable remediation will be actioned within two (2) business days of the appeal decision.

3.6 Finality of Appeal Decisions

The appeals decision under Section 3 is final within pole.world's internal process. This does not affect any right you may have to seek external redress through relevant national regulatory bodies, courts, or statutory dispute resolution schemes.

4. 18 U.S.C. 2257 Record-Keeping Compliance

pole.world is committed to full compliance with 18 U.S.C. 2257 and 28 C.F.R. Part 75, which govern the keeping of records relating to performers depicted in sexually explicit content. The following statement is published on our website in accordance with these requirements.

All models, actors, actresses, and other persons who appear in any visual depiction of sexually explicit conduct displayed on pole.world were at least eighteen (18) years of age at the time such depictions were created.

Records required to be maintained pursuant to 18 U.S.C. 2257 and 28 C.F.R. Part 75 are kept by the Custodian of Records, whose contact details are set out below. All records are available for inspection at the address and email provided during the hours prescribed by law.

4.1 What the 2257 Statement Must Contain

To satisfy the requirements of 18 U.S.C. 2257 and 28 C.F.R. Part 75, a compliant statement must include:

  • A declaration that all performers were aged 18 or over at the time content was produced;
  • A reference to the location where records are maintained (physical address required under federal regulation);
  • The name and contact details of the Custodian of Records - either a physical mailing address or an email address (or both) must be included;
  • A statement as to whether the operator of the website is the primary or secondary producer of the content, as defined by the applicable regulations;
  • Inspection hours, if required under the applicable regulatory provisions.

We strongly recommend that you seek qualified US legal advice to confirm that your 2257 statement is fully compliant before publishing, particularly given the potential criminal penalties for non-compliance.
